Can You Believe They’re Actually Taking Former ‘Playboy’ Model Dani Mathers To Trial Over This Photo?

Last July, we brought you the story of Dani Mathers, a former Playboy playmate who was in some hot water over a body-shaming Snapchat photo.

Fast-forward almost a year, and Mathers, Playboy‘s 2015 Playmate of the Year, is set to face trial over the photo.

The photo in question, which you can see below, is of an unsuspecting woman taking a shower at a gym. The photo also had the caption, “If I can’t unsee this, you can’t either.” She then shared another photo with her hands over her mouth, as if to say she was going to be sick.

Now, almost a year later, a Los Angeles judge has denied Mather’s defense motion claiming the privacy law she’s charged with violating is too ambiguous to be constitutional.

Playboy model Dani Mathers’ eleventh-hour attempt to avoid trial in her peeping Tom case was a bust Monday. A Los Angeles judge denied the 30-year-old’s defense motion claiming the privacy law she’s charged with violating is too ambiguous to be constitutional.

Mathers is charged with secretly photographing a naked 70-year-old woman in a Los Angeles gym shower last year and posting the image on Snapchat. The image was posted along with a selfie of Mathers covering her mouth in mock horror and the insult caption, “If I can’t unsee this then you can’t either.”

Playboy‘s Miss May 2014 was charged with misdemeanor invasion of privacy under a California law that prohibits the secret recording or photographing of an “identifiable person” in a home, changing room or tanning booth without the subject’s consent. In her motion denied Monday, Mathers claimed the wording of the law is too fuzzy to be enforceable. Her argument focused on the definition of “identifiable person.”

The trial is tentatively set to begin May 26, the judge said.

While Mathers’ lawyers are arguing that the photo is of an “unidentifiable person,” Los Angeles City Attorney Mike Feuer rationalized his decision to prosecute by saying that “body shaming is humiliating, with often painful, long-term consequences.”

“It mocks and stigmatizes its victims, tearing down self-respect and perpetuating the harmful idea that our unique physical appearances should be compared to air-brushed notions of ‘perfect.’ What really matters is our character and humanity,” Feuer said.

Look, I’m well woke to the fact that body shaming is no bueno, but seriously, trial? You can’t even remotely make out who the lady in the photograph is. Mathers already lost her job with Playboy, that’s punishment enough. Settle it out of court and move on with life.
